I think I should start by telling you about my areas of interest which is Real Estate. But if you feel it be better for you to invest the funds in another line of business, it will be okay by me.

I am Kenya by Origin. My health condition is not sounding too good for now, this is what gives me the impression to call for an assistant to assist me handle my investment and funds. So as you must know, I am correctly placed in a hospital rest bed for treatment. I have actually been in contact with some fund management companies but I have been reacting improperly to fear and uncertainty and this has been my major problem because most companies have given me their plans which are very good but my problem with them is the difficulty in terminating an existing position of the funds e.g. stocks and bonds. So I thought it would be a better decision to avoid too many protocols and deal with an individual whom I can talk to on how to invest, where to invest, as well as sound financial planning advice.
My health condition is not good at the moment after being treated for spinal cord injury due to an accident; I am being placed in the Rehabilitation Clinic of the Nairobi Hospital, where I had my first spinal operation in May 2005. So I have been since then been placed strictly under bed rest and also going through both physiotherapy and hydrotherapy sessions.

My reason for such investment is to secure the future of my only child whom I adopted years ago and this is why I decided to undertake a long term investment plan such as new development properties for residential and commercial. The funds in question are presently under the custody of the financial agency where it has been placed. I am cautious to provide a lot of information upfront, but would like to ask some questions that will enable us proceed further.

1. What percentage (%) of tax I am expected to pay as a non-resident of your country.
2. What happens if your government interferes in the contractual relationship between you (the foreign partner) and I (the investor) in case a breach of contract occurs? In a situation like this what are my prospects of succeeding with a claim in your local court?
3. Will there be a surety bond (Guaranty) on investment?
4. What are the possible risks and how can we manage the risk?
5. Do you know how to handle large sum of money (millions, in USD,)?
6. Do you have a company registered that can be nominated to manage such a fund?
7. Can you confirm that at this point, you have no personal financial litigation?
Against you that may hamper your ability to manage these funds?
8. Can you keep this discrete and confidential?

I know these are many questions, but I will have to be sure. If you could tell me what kind of financial instruments you have handled, and what kind of turnover you have as an individual or as a corporate entity, it will make it easier to entrust information, which, once given, I can\'t take back. Also this will aid us in preparing a legal memorandum of understanding stating our involvements and individual roles and benefits in this investment.

Though I have done business before but with my little knowledge, I know that all business transaction involve some level of risk, but there seem to be more risk in the across international border transactions than the domestic transactions and these are some important areas I would want us to identify while also looking at the possible shortfall in the expected returns on investment.

My idea about across international border investment is based on new development Properties (buying and selling of new properties) because my late father succeeded with this even with the little money he had then.

When I started investment, I have never had plans of becoming an industrialist in a foreign community due to the national difference in economic structure, political etc.

However, I would like to clearly state that what you will be doing is completely legitimate, and no laws are to be broken by your involvement.

Then he sent me a Second email wanting my information of course.

Like I explained in my second email to you, I am ill of a spinal cord injury that kept me on a wheel chair for some time now; the situation is getting worse by the day. This is actually my main reason seeking for assistant to invest my funds and manage them to secure the future of my little son, in case anything happens.

In view of the above, it is expedient that this proposal be handled with much seriousness because the amount involved is huge. I am interested in investing $76 million in total. But I intend to do it in installments to watch progress, except otherwise, I intend to start with $21.5 million. In this regard, I want you to bear in mind that your reward in any investment is going to be in form of partnership; this means that you will be entitled to certain percentage of earnings on the investment annually since you will be managing the whole investment. We are going to sign an MOU and the contract will stay as long as the investment stays.

The funds are kept with financial institution in the Europe and China. We will determine which will be more convenient when I hear from you. Then I can intimate the holding company of my intention to transfer rights and privilege to someone else (you).

So for a smooth sail of this transaction, I will explain detailed procedure on how the process is to be handled since there is every possibility that I may not be around to oversee it. So firstly, I propose to prepare a Contract agreement in form of an MOU for both of us to sign and return to each other. Your signature and mine must be appended on the MOU.

After which I will then make all relevant documents available to you regarding the transaction. You will review them and also be acquainted. Upon receipt of the documents, I can then go on to introduce you officially to the holding financial institution and communication will be established between you and them in order to process release to you.
This is how I intend to proceed with the transaction. I hope this is very ok by you? If yes, please as I have told you before, I am aware that in any investment of this sort, there must be an outlined MOU/contract agreement that needs to be entered into that will bind the investment as a contract between both parties showing responsibilities, liabilities, roles as well as profit sharing to avoid problems. I therefore urge you to let me know what percentage of profit generated annually will be acceptable to you for being in this exercise, so that I can prepare the MOU for us to sign and return to ourselves to clearly state these terms in black and white.

I will want to confirm the following details from you to prepare the contract or agreement to bind the investment. Do see below details listed. I implore you to send this vital information to me immediately so I can pass it over to the Lawyer who is to prepare the documents for us.
